THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE UNITED STATES. Entry into this Contest constitutes your acceptance of these Official Rules.
DATES: This Contest begins October 9, 2008, at 9:00 A.M. (EST) and ends 11:59P.M. (EST) on November 6, 2008 ("Contest Entry Period").
WHO MAY ENTER: Open to all legal residents of the 50 United States (including the District of Columbia) who are 18 or older at time of entry. Employees of FamilyTime.com (“Sponsor”) or its affiliates, subsidiaries, advertising, promotion and internet agencies and their immediate family members and/or those living in the same household of each are not eligible to enter or win. All federal, state and local laws and regulations apply. Void where prohibited by law. Winners are responsible for all federal, state, and local taxes on all prizes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES/CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
HERE'S HOW TO ENTER: Online Entry Only. Visit www.FamilyTime.com and find the Big Easy Turkey Thursday section on the homepage. Each Thursday for five consecutive weeks beginning Thursday October 9, 2008 FamilyTime will give away a Char-Broil® The Big Easy Oil-less Turkey Fryer. See if the Roasted Brown Turkey has been found and if not search the various pages of the FamilyTime website for the Roasted Brown Turkey with the caption Click Here To Win. If there is a Yellow Turkey in the Big Easy Turkey Thursday section on the homepage-the hunt is on. But if it’s a Roasted Brown Turkey – it’s been found and you can try again next Thursday. You will see a number of Yellow Turkeys throughout the FamilyTime site on Thursday’s but only the Roasted Brown Turkey with the caption “Click Here To Win” can make you a winner of that day's prize. If you find the Roasted Brown Turkey click on it and follow the on-screen instructions within five minutes to be that day's winner. Prize winner is the first person per day to find the Roasted Brown Turkey and click on it and follow the online instructions within a five minute period of time.
For purposes of these Official Rules, "receipt" of an entry occurs when Sponsor's servers record the entry information resulting from entrant clicking the "Claim your prize" button. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules. Internet entries will be deemed made by the authorized account holder of the email address at the time the entry is submitted. The authorized account holder is the natural person who is assigned to the email address by an Internet Service Provider or other organization that is responsible for assigning email addresses or the domain names associated with email addresses. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the winning entry. Limit one (1) entry per person/authorized e-mail account holder per day. Although subsequent attempts to enter may be received, only the first entry per day received from a particular individual email account will be eligible; subsequent attempts to enter will be disqualified. The submission of an entry is solely the responsibility of the entrant. Entries may only be made according to the method described above. Automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated service), are not permitted and will be disqualified. Only eligible entries actually received by Sponsor will be eligible for the prize. Illegible, unintelligible, incomplete, or garbled entries will be disqualified.
PRIZE DRAWING: It is the responsibility of entrants to maintain the email address used to enter Contest in good working order. All winners must meet the eligibility requirements set forth in these rules, and may be asked to sign an affidavit of eligibility, and liability and publicity release, where permitted by law, in order to qualify for the prize. Note: You are not a winner of any prize until you have been verified as a winner by the Sponsor and Sponsor decisions are final in all matters relating to this Contest.
ODDS OF WINNING: The odds of winning any Prize depend upon the total number of eligible participants playing during a given day. By entering, you represent and warrant that you are 18 years of age or older. There is a maximum of one winner per day permitted. An individual may only win once during the Contest.
PRIZES: ONE PRIZE per Thursday between October 9, 2008 and November 6, 2008 (total of five winners). Will win a Char-Broil® The Big Easy Oil-less Turkey Fryer. Retail value of approximately $150.00. Prizes to be awarded to the first individual each Thursday to find the Roasted Brown Turkey and then follow the onscreen instructions, within a five minute time period. There will be a total of five weekly winners, one for each Thursday of the Contest, and if there is not a winner for a given day that prize may not be rewarded. Sponsor has the right at its sole discretion to provide cash payment in lieu of any prize. TOTAL value of all prizes: $750.00.
ADDITIONAL RULES: All promotional winners must execute and return to Sponsor, within seven (7) days of being notified that he/she is a potential winner, an affidavit of eligibility and liability/publicity release, except where prohibited, in order to claim and be awarded his/her prize. All prizes will be shipped to the winners within four weeks of the receipt of signed affidavits. Sponsor reserves the right to provide cash or substitute prizes of approximately equal or greater value. Prize winners are responsible for all taxes related to any prize received.
If any potential winner selected fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, cannot be contacted, or does not respond within seven (7) days of initial attempted notification, or any prize is returned as undeliverable, such potential winner shall forfeit any and all rights to a prize and, at Sponsors' sole discretion, an alternate potential winner may be selected in a random drawing from among all remaining eligible entries received. Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sponsors' servers or elsewhere, will be void. Sponsor, in their sole discretion, reserve the right to disqualify any person suspected of tampering with the entry process, the operation of the website, or otherwise in violation of these Official Rules. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of the Sponsor. Sponsor is not responsible for errors in the administration or fulfillment of this promotion, including without limitation mechanical, human, printing, distribution, or production errors, and may modify or cancel the promotion based upon such an error at its sole discretion, and without liability. Sponsor further reserves the right to cancel, terminate, or modify this promotion if incapable of being completed as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort. By accepting any prize, winner agrees that Sponsor and Sponsor Entities are not liable whatsoever for any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from any winner's participation in, or his/her acceptance, possession, use or misuse of any prize awarded in connection with this promotion. In the event of a dispute, entries will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry.
WAIVER: By entering this promotion, participants waive all rights to claim punitive, incidental and consequential damages, attorney’s fees or any damages other than actual out-of-pocket costs incurred to participate.
